Section 1 — About AleviaCareMatch & Acceptance of Terms

Alevia Home Healthcare LLC, doing business as AleviaCareMatch ("AleviaCareMatch," "we," "us," or "our"), is a senior living placement and referral agency serving families throughout the Greater Houston area and the State of Texas. AleviaCareMatch is registered with the Texas Secretary of State and operates exclusively as a senior living placement and referral agency pursuant to Texas Business & Commerce Code Chapter 121. All senior living communities and care facilities to which we refer clients are independently owned and licensed by the State of Texas.

Our website at AleviaCareMatch.com, along with our telephone consultations, text message communications, email correspondence, and placement guidance services, are collectively referred to in these Terms as the "Services."

By accessing or using this Site or our Services in any capacity, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please discontinue use of this Site immediately.

Section 2 — Description of Services

AleviaCareMatch provides free senior living placement and referral services to families and individuals seeking assisted living facilities, memory care communities, independent living communities, boarding home facilities, and residential care homes in the Greater Houston area and throughout Texas.

Our Services include:

Personalized placement consultations by phone, text, and email

Assessment of your loved one's care needs, preferences, and budget

Curated referrals to licensed senior living communities that match your family's needs

Guided tours and introductions to recommended communities

Ongoing support throughout your placement decision

Our placement services are provided at no cost to families. AleviaCareMatch receives a referral fee paid directly by the senior living community upon successful placement, consistent with Texas Business & Commerce Code Chapter 121. Final placement decisions rest entirely with you and your family.

Section 3 — Texas Referral Agency Mandatory Disclosures

Pursuant to Texas Business & Commerce Code Chapter 121 (effective June 20, 2025), AleviaCareMatch makes the following mandatory disclosures to every consumer at the time of referral:

AleviaCareMatch serves as your senior living placement and referral guide

Our referral fee is paid by the senior living community, at no cost to you or your family

You are under no obligation to select any community we recommend

The list of senior living communities we provide reflects our best match for your stated preferences and needs, and may not include every available community in the area

You may stop using our services at any time, without cause or penalty

If you decide to stop using our services, we will notify all communities to which we have referred you

We will disclose the nature and amount of our compensation upon request

We refer families only to licensed or otherwise legally operating senior living communities in Texas

We consider your preferences — not cost alone — when selecting communities to recommend

Section 4 — Eligibility

You must be at least 18 years of age to use this Site or engage our Services. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms on behalf of yourself or the individual for whom you are seeking placement assistance.

Section 5 — Role of Licensed Healthcare Professionals

AleviaCareMatch's role is to guide your search for the right senior living community. All medical, clinical, and care-related decisions should be made in consultation with a licensed physician, nurse, social worker, geriatric care manager, or other qualified healthcare professional. We encourage every family to work closely with their loved one's care team throughout the placement process. AleviaCareMatch's placement guides are here to complement that professional guidance every step of the way.

Section 6 — Accuracy of Community Information

We make every reasonable effort to ensure that information about senior living communities referenced on this Site is accurate and current. We encourage families to verify all community details — including licensing status, availability, staffing, pricing, and services — directly with each facility and through the Texas Health and Human Services Commission (HHSC) at hhs.texas.gov.

Section 7 — User Conduct

By using this Site, you agree to:

Section 12 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE TEXAS AND FEDERAL LAW, ALEVIACAREMATCH AND ALEVIA HOME HEALTHCARE LLC, INCLUDING THEIR OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of this Site or our placement Services, including but not limited to the quality, safety, or suitability of any senior living community following placement, reliance on information provided on this Site, or interruption or unavailability of the Site.

Our total cumulative liability to you for any claim arising out of or related to these Terms or our Services shall not exceed $100.00.

You agree to indemnify, defend, and hold harmless AleviaCareMatch, Alevia Home Healthcare LLC, and their owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of this Site, your violation of these Terms, or any false or inaccurate information you provide to us.

THIS SITE AND OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALEVIACAREMATCH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Section 15 — Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any dispute shall first be pursued through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Montgomery County, Texas, conducted under the Texas Arbitration Act (Texas Civil Practice & Remedies Code Chapter 171) and administered under American Arbitration Association (AAA) rules. Each party waives any right to a jury trial or class action participation.

Section 16 — Texas Consumer Protections

These Terms are intended to operate in full compliance with the Texas Deceptive Trade Practices Act (DTPA), Texas Business & Commerce Code Chapter 121, and all applicable Texas consumer protection laws. Nothing in these Terms limits any right you hold under Texas law that cannot be waived by private contract.
